These Terms and Conditions govern all orders placed with Rinova Pergola (“Rinova Pergola”, “we”, “us”, or “our”) through our online store, including orders made via phone, chat, email, or direct checkout on Shopify.
By placing an order, you (“Customer”, “you”, or “your”) agree to be bound by these Terms and Conditions, along with our Shipping Policy, Cancellation Policy, Refund Policy, Return Policy, and 100-Day Risk-Free Trial Policy.

2.2 Product listings on our website, as well as draft orders placed via phone, chat, or email, do not constitute a legally binding offer. They are an invitation for you to place an order.
2.3 For online purchases, an order is created when you click a button such as “Buy Now”, “Order Now”, “Pay Now”, or “Complete Payment” for the selected products. For orders placed via phone, email, or chat, an order is formed once you provide final confirmation (e.g., written or verbal confirmation documented by us).
2.4 If there are any discrepancies between the order confirmation and what you intended to order, it is your responsibilityto promptly notify Rinova Pergola so that we can amend the contract. If you do not notify us within 24 hours of receiving the confirmation, any misunderstandings, incorrect items, or additional costs arising from the discrepancy will be at your own risk.
2.5 Rinova Pergola reserves the right to cancel an order if it is based on incorrect information, such as pricing errors, typographical mistakes, or technical inaccuracies displayed on our website or communicated in error. The contract only becomes final once the goods are dispatched by us. In the event of cancellation, we will notify you and refund any payments in accordance with our Refund Policy.
3.1 We make every effort to ensure that all products displayed on our website are available to order or pre-order; however, we do not guarantee availability. This electronic publication does not, by itself, constitute a binding offer for sale.
3.2 All measurements are approximate. Small deviations in dimensions, color, or finish may occur due to manufacturing tolerances and screen/display variations.
3.3 Most products require partial or full assembly. It is your responsibility to confirm assembly requirements before purchasing if this is a condition of your purchase.
3.4 We strive to reproduce product colors as accurately as possible, but we cannot guarantee that your device’s display will reflect the exact color or finish.
3.5 All risk in the products (including risk of loss or damage) passes to you once the products are delivered to the address specified on your order. Ownership of the products does not pass to you until we have received full payment.
3.6 We shall not be liable for any indirect losses you may suffer, including loss of profit, loss of income, wasted time (including time off work), or anticipated savings, arising from our failure to comply with these Terms or from negligence, except where prohibited by law. Our liability for death or personal injury caused by our negligence is not restricted.
3.7 These Terms constitute the entire agreement between you and Rinova Pergola regarding the supply of products and supersede any prior verbal or written communications.
3.8 We may amend these Terms from time to time at our discretion. Any changes will be posted on this website and will apply to orders placed after the date of publication.
3.9 Our failure or delay in enforcing any right or provision of these Terms does not constitute a waiver of that right or provision.
3.10 If any provision of these Terms is held by a court to be invalid or unenforceable, that provision will be restated to reflect as closely as possible the original intent, and if that is not possible, it will be severed. The remaining provisions will remain in full force and effect.
3.11 You may not assign or subcontract any of your rights or obligations under these Terms without our prior written consent. No third party shall have any rights to enforce any term under these Terms.
3.12 All matters relating to any offer, agreement, or sale of products from our website shall be in English and shall be governed by the laws of the State of California, USA. The state and federal courts located in California shall have exclusive jurisdiction over all such matters, to the extent permitted by law.
4.1 Rinova Pergola shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, war, acts of government, supply chain disruptions, transport failures, or other events that make performance inadvisable, commercially impracticable, illegal, or impossible.
5.1 Unless explicitly stated otherwise, the prices displayed on the website exclude delivery charges. Any applicable delivery charges will be shown at checkout after you enter your delivery address, but before any payment is processed.
5.2 Any “reduced” or “sale” prices displayed (including clearance prices) represent a reduction from the standard price previously charged on the website.
5.3 Prices during promotions or sales are limited-time offers and apply only to orders placed during the specified promotional period. Orders placed outside that period will not qualify for sale pricing.
6.1 Payment for Rinova Pergola products can be made using the methods specified on our website (e.g., credit/debit card, financing providers, or other payment gateways). By choosing a particular payment method, you agree to the terms, conditions, and privacy policies of the relevant payment provider.
6.2 Payment is typically taken automatically at the time we receive your order. All orders are subject to product availability. If we are unable to supply the goods, we will inform you as soon as reasonably possible and issue a refund if payment has already been made.
6.3 The price payable is the price displayed on the website at the time we receive your order, subject to correction of errors.
6.4 While we work hard to ensure accurate pricing, errors may occur. If we discover a pricing error for goods you have ordered, we will inform you as soon as possible and offer the option to either:
reconfirm your order at the correct price, or
cancel the order.
If we are unable to contact you, we will treat the order as canceled. If you cancel and have already paid, you will receive a full refund.
6.5 Title (ownership) in any products passes to you upon delivery, provided that we have processed and received full payment for the products.
7.1 Rinova Pergola is not responsible for obtaining any permits, approvals, or other documentation required for installation.
7.2 It is your sole responsibility to determine whether any permits, approvals, or inspections are required under local, city, county, state, HOA, or other regulations and to obtain such approvals at your own cost.
8.1 The Risk-Free Order option is designed to allow you to temporarily secure pricing or product allocation while you finalize approvals or details. Typical situations include:
Waiting on HOA approval and wanting to lock in current pricing.
Confirming color, size, or accessories with a partner or decision-maker.
Needing to visit the property to confirm dimensions or details.
8.2 This option does not apply to Customers who simply wish to delay delivery, are waiting for backyard or construction completion, or lack storage space for the pergola.
8.3 Risk-Free Order Process:
A Risk-Free Order must be placed through the Rinova Pergola sales team.
A draft order will be created including a non-refundable “Reserve Now” fee of $100.
The $100 fee must be paid immediately to secure your reservation.
The remaining balance is due within 48 hours of the product becoming available for shipment.
If the product is in stock at the time of reservation, full payment is required within 24 hours.
If full payment is not received within 7 days of the product being ready to ship, the order may be canceled and the $100 reserve fee forfeited.
By using the Risk-Free Order option, you agree to these specific terms.
9.1 The Storage option allows you to purchase a pergola and have it stored for up to six (6) months before delivery.
9.2 The maximum storage period is six (6) months from the date of purchase. If you cannot receive the pergola within this period, you must arrange extensions with us in advance; additional fees will apply.
9.3 A storage fee of $150 per month will be charged during the storage period. Storage fees are non-refundable and accrue monthly once your order is ready to ship.
9.4 A Rinova Pergola representative will contact you after purchase to confirm your preferred delivery timeframe. It is your responsibility to ensure availability and access for delivery within the agreed window.
10.1 Ownership of all goods remains with Rinova Pergola until payment has been received in full for the relevant order.
11.1 Warranty Coverage
Rinova Pergola products are covered by a tiered limited warranty:
10-Year Warranty on structural components (e.g., columns, base plates, beams).
5-Year Warranty on movable parts (e.g., louvers, manual mechanisms).
2-Year Warranty on accessories and electrical components.
11.2 Warranty Activation
The warranty period begins on the date of delivery. Your original receipt or order confirmation serves as your proof of purchase and warranty certificate.
11.3 Warranty Conditions
The warranty is non-transferable and applies only to the original purchaser within the United States (and any other territories we explicitly list on our site).
Coverage is limited to the original purchase price and/or replacement of parts. You are responsible for installation of any replacement parts.
11.4 Exclusions
The warranty does not cover, for example:
Damage due to extreme weather, natural disasters, or conditions beyond what is documented in Rinova Pergola’s engineering guidelines.
Misuse, modifications, improper installation, or abnormal loads.
Installation on unstable surfaces or incorrect assembly.
Installations delayed excessively (e.g., more than one year after purchase).
Normal wear and tear, scratches, or cosmetic issues arising from use.
Rust caused by internal condensation in steel components.
Damage from aggressive chemicals, improper cleaning, or poor maintenance.
Costs related to disassembly, reassembly, shipping, storage, or third-party labor.
11.5 Filing a Warranty Claim
To submit a warranty claim, you should:
Notify us within 30 days of discovering the issue.

Order number / proof of purchase
Detailed description of the issue
Clear photos and/or videos of the defect
Approved warranty claims will be processed within a reasonable timeframe, typically within 30 days.
11.6 Rinova Pergola may withhold warranty benefits if there are outstanding payments on the order.
12.1 We are fully liable where required by law, including:
For injury, loss of life, or health issues caused by our intentional or grossly negligent conduct.
For defects where a warranty explicitly guarantees certain properties.
For claims under applicable product liability laws.
12.2 For minor negligence relating to essential contractual obligations, our liability is limited to foreseeable damages typical for this type of contract. This limitation does not apply where prohibited by law.
12.3 Our referral partners, carriers, or third-party installers act independently; Rinova Pergola is not liable for their separate acts or omissions.
13.1 Rinova Pergola will remedy product damage due to material defects if:
The product was assembled strictly in accordance with our instructions;
Appropriate precautions were taken against weather and environmental exposure;
The Customer checked completeness and visible condition of all parts prior to assembly.
13.2 Damage caused during assembly due to ignoring obvious defects, improper tools, or incorrect installation is excluded from warranty and may require paid replacement parts.
14.1 Before hiring a third-party installer, you must verify that:
All boxes and pallets have arrived;
All visible parts are free from obvious damage;
The delivery matches your order.
14.2 Rinova Pergola is not responsible for any costs, damages, or delays arising from incomplete deliveries, scheduling conflicts, or errors made by third-party installers. Any installation agreement you enter into is strictly between you and the installer.
15.1 If your order is delivered with visible transport damage, you should:
Note the damage with the driver or carrier at the time of delivery, if possible;
Take clear photos of the damage and packaging;
Contact info@renovapergola.com as soon as reasonably possible.
Failure to note damage at delivery does not remove your statutory rights, but it may limit our ability to recover costs from the carrier and can delay resolution.
15.2 If you refuse delivery without visible damage or valid reason, you may be responsible for additional costs, including re-delivery fees, return transport, and handling charges.
16.1 Our standard shipping arrangements are for delivery to customers within the contiguous United States. Delivery to Alaska, Hawaii, or other locations may be possible only by separate written shipping agreement and may involve additional charges.
16.2 Standard delivery generally includes:
Manual unloading of cartons from the truck (liftgate or forklift may be used for large or heavy orders).
Removal of cartons from pallets.
Placement of cartons in a reasonably accessible, dry area (e.g., driveway, garage, or accessible backyard area).
Delivery to raised areas (e.g., rooftop terraces) or locations requiring special equipment or extended carrying distances will incur additional charges.
16.3 We make every effort to meet quoted delivery timeframes, but delivery dates are estimates and may be affected by carrier capacity, weather, logistics constraints, or other unforeseen events. Rinova Pergola is not liable for delay or failure to deliver within estimated timescales.
16.4 You must inspect items within 7 days of receipt. Any issues—such as damages, faults, missing items, incorrect products, or unsuitability—must be reported to info@renovapergola.com within that period.
16.5 You must provide complete and accurate delivery information, including full address and recipient name. Rinova Pergola is not liable for failed deliveries caused by incomplete or incorrect information. Deliveries may require a signature.
If you encounter defects or issues with a purchased product, you may have statutory warranty rights where applicable.

We will review your complaint and respond with next steps.
18.1 Free Cancellation (within 24 hours):
You may cancel your order within 24 hours of placement at no cost, provided the order has not already shipped.
18.2 Cancellations after 24 hours:
For orders canceled more than 24 hours after placement (and prior to shipment), a 10% cancellation fee will be applied to cover administrative and allocation costs.
18.3 If the item has already shipped, additional return shipping and restocking fees will apply, as outlined in the Return Policy below.
19.1 You must inspect your order within 7 days of delivery. Any issues (damages, faults, incorrect products, missing parts, or unsuitability) must be reported to info@renovapergola.com within that period.
19.2 When a refund is approved (for example, due to product unavailability, irreparable damage, or other qualifying reasons), refund processing will typically begin within 1–10 business days.
19.3 A full refund will be provided if:
A product is not available and no suitable alternative is acceptable to you; or
A product is damaged or faulty and a replacement cannot be supplied.
Rinova Pergola reserves the right to provide a replacement product where it is reasonably available and appropriate.
Note: Rinova Pergola does not perform direct “exchanges” for pergola structures. To obtain a different model or configuration, you must return the original product (if eligible) and place a new order.
If you wish to return a full pergola after delivery, the following terms apply:
Eligibility Window
Full pergola returns are accepted within 30 calendar days of delivery.
Cancellation Fee
Orders canceled or returned after 24 hours are subject to the 10% cancellation fee described in Section 18.
Return Shipping & Packaging
You are responsible for properly repackaging and palletizing the pergola for secure transport.
You may either:
arrange your own carrier, or
request to use Rinova Pergola’s shipping partner (where available).
Return Shipping Costs (if using our carrier)
If you choose our carrier for a full pergola return within the continental U.S., a $1,000 return shipping charge will be deducted from your refund, in addition to a $500 restocking fee.
Inspection Upon Arrival
Once the pergola arrives at our facility, we will perform a detailed inspection.
If the pergola is in good, re-sellable condition, we will issue a refund within 10 business days, less:
10% cancellation fee;
$500 restocking fee;
applicable shipping charges (including the $1,000 return fee if our carrier was used).
If the pergola arrives damaged or in a condition that reduces its resale value, Rinova Pergola reserves the right to reduce or withhold the refund accordingly.
Customer’s Risk
All returns are shipped at your risk. If the pergola is damaged in transit during a Customer-arranged return, you must pursue any claim directly with the carrier. Rinova Pergola is not responsible for damage occurring during return shipping.
If you cancel a pergola order already in transit, a $1,000 recall and restocking fee will be applied, in addition to the 10% cancellation fee. These amounts cover carrier recall and handling costs.
If you wish to change a full pergola order while in transit, a $1,000 recall and restocking fee will apply.
The standard 10% cancellation fee will not apply if you place a new order for another pergola of equal or greater value.
Accessories may be returned for a refund, subject to the following:
You are responsible for all return shipping costs.
All accessories are inspected upon return; refunds may be reduced for damage, signs of installation, or diminished resale value.
Fees per accessory (per item, unless stated otherwise):
Wall-based accessories (screens, glass doors, aluminum or wood slat walls):
10% cancellation fee (on the item value)
Standard return fees (per item, maximum as noted):
Screen: $500 each (max $1,000 total)
Glass Wall: $750 each (max $1,000 total)
Aluminum / Wood Slat Wall: $500 each (max $1,000 total)
Heater: $50
Ambient light / lighting accessories (e.g., Everglow, LED kits): $50 each
Only Customers who purchased directly from Rinova Pergola, with a valid Rinova Pergola order number, are eligible to return merchandise.
21.1 All pergolas and accessories purchased directly from Rinova Pergola are eligible for a 100-day risk-free trial, giving you time to evaluate the product after installation.
21.2 To qualify, the items must be fully installed and used as intended.
21.3 The trial period begins 10 days after dispatch from our warehouse, providing up to 100 days from that date to initiate a return.
21.4 You are responsible for all return shipping costs (and applicable fees) as described in the Return Policy. No reason is required for the return, provided you meet the conditions and timelines set out here.
21.5 Any damage not documented at delivery will result in a reduction in the refund amount.
21.6 The 100-day risk-free trial extends your return window; it does not waive:
the standard 10% cancellation fee,
applicable restocking fees, and
shipping charges (original and/or return).
All such fees still apply to orders canceled under this policy.
22.1 Eligibility
The referrer must be an existing Customer who has placed at least one completed order.
The referred friend must be a new customer who has never purchased from Rinova Pergola before.
22.2 Purchase Requirement
The referred friend must purchase a pergola after the referrer has received their own order.
22.3 Order Verification
Both the referrer and the referred friend must contact info@renovapergola.com with:
their respective order numbers, and
a brief confirmation that the purchase was made via referral.
Verification must be completed within 30 days of the referred friend’s purchase.
22.4 Rewards
Both the referrer and the referred friend will receive either:
a designated free accessory (e.g., lighting product of similar category), or
a $150 gift card for the Rinova Pergola store.
Gift cards will be issued electronically.
Rewards are subject to verification, availability, and program rules in place at the time of the referral.
22.5 General Terms
One reward is issued per qualifying referral.
Fraudulent or self-referrals are not permitted and will be disqualified.
The referred friend’s purchase must include a pergola structure to qualify.
Rinova Pergola reserves the right to modify or cancel the referral program at any time.
By participating, you agree to these refer-a-friend terms.
Customers seeking federal or state tax exemption must email valid documentation (e.g., resale or exemption certificate) to info@renovapergola.com before placing an order.
Tax exemptions cannot be applied retroactively to orders already processed.
24.1 These Terms represent the full and final agreement between you and Rinova Pergola.
24.2 For any matters not expressly covered here, the laws of the State of California apply, to the extent permitted by applicable law.
